Comments

When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

Media

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

Cookies

If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

If you visit our login page, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

How long we retain your data

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

What rights you have over your data

If you have an account on this site, or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.

Introduction

Ashburton Repair Cafe (the CIO) will hold data on persons, it is appropriate and necessary to have a policy in place to govern the safe retention of that data. Ensuring that the personal data that the CIO holds about its trustees, volunteers, customers and other stakeholders is managed and processed appropriately is a legal responsibility.

Specifically, this policy sets out the CIO’s commitment to handling personal data in accordance with the Data Protection Act 2018 (the Act) and the General Data Protection Regulations (GDPR). 

The Information Commissioner’s Office (ICO) is the UK’s supervisory authority. Their website, https://ico.org.uk/, contains useful information about data protection and this policy has been drafted in accordance with that guidance.

Scope and Responsibility

The trustees collectively have responsibility for ensuring compliance with the Data Protection Act 2018 and the GDPR for the CIO. 

This policy cannot cover all of the ramifications of the legislation. Anyone who is uncertain of their responsibilities should, in the first instance, consult the Data Protection Officer (see below).

 

Data Protection Principles

The GDPR are underpinned by six principles which govern how the CIO must process personal data. All trustees, and volunteers who handle personal data, need to be mindful of these when processing it. They are summarised here:

Lawful, fair and transparent.

Data collection must be fair, for a legal purpose and we must be open and transparent as to how the data will be used. 

Limited for its purpose

Data can only be collected and then used for a specified purpose, and only that purpose.

Data minimisation

Any data collected must be the minimum necessary for its purpose.

Accurate

The data we hold must be accurate and kept up to date.

Retention

We cannot store data for longer than necessary and should have a clear strategy for deleting data when it is no longer needed.

Integrity and confidentiality

The data we hold must be kept safe and secure.

 

Data Management

The CIO will make every effort to ensure that data held is accurate. In accordance with the principles (above), we will correct any errors as soon as we are notified.

Rights of Data Subjects

All volunteers, trustees and customers have rights in relation to the personal data that the CIO holds about them. Not all rights are automatic, and some may not be available in certain circumstances where a lawful exception applies. 

Applications from an entitled party to view the data held on them should be passed to the Data Protection Officer. Such requests will be dealt with as promptly as possible and in not more than ten working days.

Security Incident Management and Notification

An information security incident can occur when the confidentiality, availability and or integrity of personal data is put at risk. 

Any security incident, no matter how seemingly minor, should be reported to the Data Protection Officer. The GDPR require us to log all incidents and this also enables us to monitor incidents and provide appropriate training to those involved.

Each security incident will be logged in the Data Protection Incident Log. It will then be analysed and further research undertaken if necessary to ascertain the scale of the incident.

Data Protection Officer

The Data Protection Officer is the CIO’s Secretary. They will provide advice and support to customers, volunteers and trustees about data protection matters and ensure that appropriate documentation is made of all personal data processing undertaken by the CIO.

The Data Protection Officer will act as the single point of contact for the Information Commissioner’s Office or other relevant supervisory authorities and will ensure that compliance risks are reported within the CIO as required.

Review

This policy will be reviewed at intervals of not less than two years, or earlier in the event of a relevant incident or of a change in legislation.

The original policy (and updates) were agreed at a meeting of the CIO listed on 26 June 2023.
